Who is telling the truth?
This is Timothy Bowman. Last month he was arrested and charged with planning the escape of his fiancee from court ordered mental health confinement. Local police officials have accused Mr. Bowman of being violent and dangerous. A warrant was issued, after he allegedly trespassed on private property during a purported “breakout attempt.” Hospital officials say he was seen throwing a snowball at the window of a patient, signaling the other conspirators in the planned escape.
Policeabuse.com is accused of helping Tim Bowman. Our stretch limo was identified as the getaway car. We admit that we are guilty of helping Tim Bowman, but not with an escape. We gave him the help he needed to document a serious case of patient abuse, civil rights violations and incompetence. We went undercover inside the NY state mental health system with hidden cameras. When you hear this story you will understand why we gave him our full support.
We got involved because Mr. Bowman said that the police in Rochester, NY, were unfair and abusive. After a report we determined to be false was made against Mr. Bowman we attempted to provide the local police department with correct information. However, the investigating officer had an emotional fit in the lobby of the police station. He kept screaming that we had lied to him. He told us that we were responsible for his migraine headache and he did not need to hear our information. This was the response our investigators received when we tried to provide witness statements to Officer Britton of the Rochester PD. We will provide the entire audio to Mr.Bowman’s defense attorney.

The allegations made against Mr. Bowman are based on a report by this man, John Zehr. John Zehr’s complaint to the Rochester police department is at the heart of our story. John Zehr is the hospital administrator for the Shore Winds, one of New York’s worst nursing homes.
According to NY state health records obtained by Policeabuse.com, the Shore Winds has nearly double the number of health code violations to that of other nursing homes in New York (compared to the state wide average). Four months ago state investigators launched an investigation into charges of patient sexual abuse at the same facility.

Tim Bowman’s fiancée has been in solitary confinement at the Shore Winds, for nearly four months. The Shore Winds staff said she had dementia. From the beginning Pat and Tim disputed the dementia diagnosis stating that Pat suffered from Hyperthyroidism an illness with symptoms sometimes mistaken for dementia.
Ultimately, the dementia diagnoses was withdrawn. Now, according to her guardian Catholic Family Services, Pat Kobylak remains at the Shore Winds due to a shortage of beds at other assisted care facilities the court has recommended.
In the interim Pat Kobylak will remain at the Shore Winds. She is allowed to shower once a week. Although she has never committed a crime, she must wear an ankle bracelet that sets off alarms anytime she nears an elevator or exit door. She is restricted to inspected meals prepared at the Shore Winds. She is pressured to take a pill each day containing a medication called Risperdal. Before being confined at the Shore winds she was working a full time job, maintained a bank account and had received several promotions at work. Tim Bowman is barred from visiting her. This a letter from Pat describing her condition to the court.
On 1/27/2009 John Zehr filed an order of protection with the Monroe County Court, stating that Tim Bowman was involved in a disturbance and possible escape attempt. This is one of several complaints made by Zehr to the police and a court appointed guardian about Mr. Bowman. According to Zehr, the entire facility had to be placed “on lock-down.”
This is from John Zehr’s written statement given to the police. The “Defendant” Zehr is referring to is Tim Bowman.
“Defendant became agitated and became verbally abusive, acted out, and repeatedly screamed that The caregivers were trying to kill the patient, Pat Kolbylak.
The Defendant was calmed down and a schedule of visitation was set up for him. Soon, on his first or second visit, Defendant was on the nursing floor Defendant had to be removed because of his, temper, outbursts and potential for harm to the other residents.”
There is just one problem with Mr. Zehr’s story. It is not true. Zehr did not know hidden cameras were recording the incidents he describes above in false police reports submitted over several months. We also invited a local news crew to document the “breakout.” They witnessed many of the events falsified in Zehr’s report to the police.
Mr. Bowman, told Policeabuse.com that John Zehr and staff at the Shore Winds staged confrontations with him, to justify the false reports against him.
In the confrontation above, Zehr reported to the police that Mr. Bowman began screaming at nursing home staff. This is just one of the allegations that Zehr listed in his complaint to the Monroe Co. Courts to obtain an order of protection. Mr. Zehr did not know until today that a remote recording device sealed in Mr. Bowman’s jacket, was activated moments before the altercation took place. What the tape shows is, Mr. Bowman and his fiance’ having a private lunch. Suddenly, hospital staff members entered Patricia’s room and began criticizing Mr. Bowman about a written complaint that he had faxed to the nursing home, at the request of Ms. Kobylak.
We obtained the footage of the “disturbance” Dec. 15Th, 2008. In the tape Mr. Bowman is heard complaining that Ms. Kobylak is not being treated for her condition. He is not screaming nor is he doing any of the other things described in the police report.
These are the facts based on a six month Policeabuse.com hidden camera investigation:
On August 3, 2008 a police report was filed with the Monroe County sheriffs office. The report is under seal ,though we know its contents. The report alleges that Timothy Bowman was a threat to the safety of his domestic partner Patricia Kobylak. It also alleged that Tim and Pat suffered from mental illness. The report contends that Tim and Pat use experimental medications and practiced bizarre religious rituals. A court appointed guardian, Linda Ricigliano, of Catholic Family Services has accused Mr. Bowman of trying to poison Pat Kobylak with supplements. The supplements were vitamins prescribed by a doctor. For six months before the bogus charge that Tim Bowman was trying to poison Pat he brought her fresh cooked meals each day until hospital staff confronted him over the dangers of sea salt. His visitation was cut off because he smuggled fresh food and bottled water into the hospital. Our investigators photographed this meal as it was delivered to Pat.

How it started
On August 4, 2008 Ms. Kobylak did not return home from work at her usual time. At 1:30 p.m. Timothy Bowman found her car abandoned in front of his home. The doors were unlocked and the keys were on the floorboard. At 2 PM Mr. Bowman went to the Irondequoit Police Department to report that his girlfriend Patricia Kobylak was missing.
We learned that Ms. Kobylak was confronted at work by her brother Ted and his wife at about noon. They convinced her to come to their car. According to Pat she was told by her brother that they were taking her to lunch, instead she was forcibly taken to her brother’s home. This is the letter Pat wrote to the court about her “abduction.”
After returning home from the police department, Tim noticed Pat in a car with her brother, along with 2 Irondequoit police officers. The police ordered Tim Bowman to allow them into the residence. When he told them that he did not have a key, he was ordered to climb through the window of his home. Initially, he refused to allow the police into his home. Mr.Bowman said that he changed his decision after being warned by the officers that they could break into his house. They told him he might be arrested if he did not cooperate.
Officers Laird and Frederico entered the residence accompanied by Patricia Kobylak’s brothers and removed several items of clothing.
The brothers left with Patricia Kobylak and returned to their home. Later, they called for an ambulance. Patricia was taken to Strong Memorial Hospital where she remained for 5 months. She was transferred to the Shore Winds after the NY state mental health board launched an investigation into the forced medication of Ms. Kobylak. Timothy Bowman filed the report that caused the investigation. Hospital officials were not pleased.
Policeabuse.com assigned the case to an investigative team including an attorney specializing in family law, a second civil rights attorney and a police misconduct expert. In addition to assisting Mr. Bowman with a variety of legal issues, we undertook a hidden camera investigation into the operations of the hospital and the local police. For six months we posed as patients and visitors to collect evidence for this story. We also equipped and trained Timothy Bowman in the use of miniature recording devices. We cannot release our entire report because much of our evidence is being preserved for Mr. Bowman’s criminal case. However we will share our thoughts about the conduct of the police and hospital administrator.
The allegations
Mr. Bowman reported that the 2 officers that responded to the call at his home were rude and unprofessional. He told us that they would not give him a chance to speak. Officer Laird reportedly told Mr. Bowman to shut up and get a new girlfriend. We took hidden recorders with us into the Irondequoit police department as we attempted to report Mr. Bowman’s complaint. You can be the judge of Officer Laird. Does he sound professional? Laird informed us that he takes his own complaints. This is the audio. Compare his conduct to officers from the Monroe County Sheriffs Office. This is the chief’s reaction to our complaint.
Tim has continuously complained about the poor medical treatment of his fiance’. There is little doubt that his persistent complaints infuriated hospital staff. Consequently, he has lost all contact with the woman he lived with happily for nine years. Tim and Pat planned to marry just a few months ago.
Tim’s family and his friends have been retaliated against. Last month Tim’s elderly mother who is in a nursing home was barred from calling or visiting Pat Kobylak. John Zerh had her banned from visitation claiming the elderly woman’s phone calls pose a risk to Pat Kobylak’s safety. Even a nine-year-old neighbor of Tim and Pat was recently turned away and prevented from visiting. She was told Mr. Bowman was dangerous and visitation was restricted.
We were stunned to learn during our investigation that some of the hospital staff caring for Pat Kobylak agree with Mr. Bowman. Listen to this undercover audio we recorded and you be the judge. The nurse caring for Pat Kobylak tells us that keeping her in mental health confinement is “inhumane.” We will update this story in the coming weeks. We plan to attend Tim Bowman’s trial in May. We have some tape the court needs to hear.
At a court hearing 18 of Pat Kobylak’s family members testified that she must be confined for her own good. Many of the family members described Tim Bowman as a violent abusive man. Pat had not seen many of the people claiming to have her best interests in mind for years. In fact, Pat had only seen her family on two occasions in the 3 years before they committed her to a mental hospital. When the judge asked Pat’s family if any of them would care for her or allow her to stay with them all 18 declined.
We checked Tim Bowman’s record. He has never been arrested and there has not been a single call to the police concerning domestic incidents at his home. With exception of the uncorroborated claims by Pat’s family his reputation is impeccable.
From our time with him we can say that Tim Bowman, is one of the most mild manner people we have met. He does not have anything in his background to justify the abuse he has been subjected to. An anonymous report made to the police has ruined his life. We will do our part to make him whole again.
Based on the testimony of Pat Kobylak’s family, the court granted guardianship to Catholic Family Services. So far, along with court appointed lawyers, they have levied nearly $15,000.00 against Pat’s savings for treatment she did not ask for. The cost for a bed at the Shore Winds is approximately $275.00-$300.00 per day or about $10,000.00 per month.
